Him-Chan (former B.A.P) was sentenced to 5 years of suspended sentence for only 3 sex crimes? The public continues to voice outrage over the extremely light sentence.

The public is outraged after Him-Chan , a member of the group "B.A.P.," was sentenced to five years of probation for alleged sexual assault and indecent non-consensual behavior.

On the morning of the 1st, the Criminal Agreement Division 12 of the Seoul Western District Court held a sentencing hearing for Him-Chan's alleged violation of the Special Act on Punishment of Sexual Assault and Sexual Violence Crimes (filming using a camera, etc., and indecent acts using a communication medium). The Trial Chamber sentenced Him-Chan to three years in prison, suspended for five years.

The court also ordered probation, 40 hours of attendance at a sexual assault treatment protest, three years of restricted employment at an institution related to children, youth, and persons with disabilities, and three years of disclosure of information, and ordered, "During the period of probation, you must not approach or contact the victim or her family, you must not drink alcohol with a blood alcohol content of 0.05% or more, and you must not respond to a probation officer's request for testing to confirm whether you have been drinking or not." The court imposed a special compliance requirement that "the defendant must comply with requests for testing by the probation officer to determine whether he has been drinking or not."

The Trial Chamber noted that "the defendant is highly blameworthy in that he committed the crime in this case again without refraining from committing the crime, even though he is currently on trial for the same kind of crime, and that he betrayed the trust of the victims who were concerned about him as a fan of the idol group to which the defendant belonged. The reason for the sentence was that Him-Chan admitted all the crimes and agreed with the victims that all the videos were not deleted or disseminated.

As a result, the public is outraged at Him-Chan for avoiding a prison sentence. The punishment is too weak for three sex crimes alone.

Him-Chan was sentenced to 10 months in prison at the first trial in February 2021 for committing a nonconsensual indecency with a woman in her 20s at a pension in Namyangju, Gyeonggi, in 2018, and then sentenced to 10 months in prison at the second trial held last February. However, without completing the trial, he committed an additional crime of indecent assault by grabbing a woman's waist and touching her shoulder area at a restaurant in Yongsan last April, and in May of the same year, he sexually assaulted another victim in Eunpyeong-gu and illegally photographed her before forwarding the photos.

Him-Chan was jailed for the first non-consensual indecency offense and served a 10-month sentence last December 8th, but is still being held and tried for the additional crimes charged.

From September to December last year, Him-Chan submitted more than 20 letters of remorse and appealed for good behavior, and the Trial Chamber stated, "All of the defendant's crimes are related to alcohol. It is objectively clear that he is not in good health, but he should stay away from alcohol," the court reportedly urged. Netizens could not hide their anger at this, saying, "Are we going to tolerate him just because he drank alcohol?", "This is too light a punishment," and "I cannot agree with the sentence even though he has committed three sex crimes alone."
