A 30-something idol member who even received a diagnosis of mental disability in an attempt to avoid active military service has been sentenced to a suspended prison sentence.

According to the legal community on the 17th, Judge In Hyunjoon In of the 3rd Criminal Division of the Northern District Court of Seoul sentenced a certain Ahn, who was indicted for violating the Military Service Act on the 11th, to one year of imprisonment with two years suspended, and ordered him to perform 80 hours of community service.

Prior to this, Ahn was suspected of attempting to evade his military service obligation after being issued a medical certificate for acting as if he had intellectual capacity problems, despite having been judged eligible for active duty enlistment with physical grade 1 and grade 2 in 2011 and 2017, respectively.

The allegations are that he received medical treatment at a hospital in Dongdaemun-gu, Seoul, for approximately seven months from October 29th, 2019, to May 22th, 2020, acting as if he had a mental problem and giving exaggerated and distorted answers in a comprehensive psychological examination as if he had psychological problems and cognitive dysfunction. The investigation was conducted.

In response, he was issued a military medical certificate stating that he needed at least one year of psychiatric observation and medication, and in May 2020, he was declared a "borderline intelligence and intellectual disability," making him subject to call-up as a Level 4 social service member.

However, it was revealed that Ahn had been active both in Korea and abroad as an idol group member from 2012 to 2022, and had no special mental health problems.

The court stated that "Ahn has admitted his mistake, this is his first offense, and he has pledged to fulfill his military service obligations in the future," and explained the reasons for the sentence, "In addition, the court considered the defendant's age, sexual behavior, environment, motive, means and results of the crime, and post-incarceration circumstances."
