”If only there hadn't been a murder”... Stalker repeats stalking of actress after release from prison = South Korea
A man who was sentenced to prison for stalking actress Kwak Jin Young is currently on trial after committing another crime after being released from prison.
According to SBS on the 10th, the Seoul Southern District Court recently held a trial against defendant A, a man in his 50s, for violating the Stalking Punishment Act.
Defendant A has been threatening Kwak Jin Young 95 times through social media messages since June last year, and after being banned from contacting her, he posted a message about Kwak Jin Young on his social media profile.
In February of this year, he was indicted without detention on suspicion of stalking a total of 132 occasions, including posting photos of the victim and threatening messages.
Defendant A transferred 1 won each to Kwak Jin Young's account over 1,000 times and left threatening messages.
He was arrested in 2021 for malicious stalking and sentenced to one year and six months in prison, but continued to commit crimes even after his release.
While defendant A reportedly denied the charges of stalking in court, Kwak Ji
Nyong expressed his anger, saying, "I naturally thought I would be arrested this time too. It seems people don't recognize something unless a murder actually occurs."
The prosecution explained that the reason for not detaining defendant A was "a decision made after taking into consideration all circumstances, including the method of the crime."
However, it was reported that the decision was made after taking into consideration the fact that defendant A had not met Kwak Jin Young in person. Kwak Jin Young said, "If defendant A had not come to see me in person, I would not have been able to do so.
"The police told me to return the protective equipment if I had not caused any harm," he said. "What is more direct about this? The person who reported it to the police is the one who was being harmed.
Although reports of stalking have increased in the two years since the Stalking Punishment Law came into effect, the percentage of criminal suspects being detained by the police is in the single digits.
According to documents submitted by the National Police Agency in September to the office of Rep. Chung Chun-sen of the Fatherland Reform Party, who is a member of the National Assembly's Administrative and Security Committee, the punishment for stalking crimes, etc.
Since the law came into effect on October 21, 2021, the number of stalking crime cases filed in South Korea has increased to 9,895 in 2022, 11,520 in 2023, and 12,677 last year.
However, the percentage of suspects in crimes for whom warrants were issued and who were detained remained in the 3% range, at 3.35% in 2022, 3.06% in 2023, and 3.04% last year.
Jeong said, "In the case of crimes such as stalking and sexual assault, there is a high risk of recidivism, so investigations must be conducted after the perpetrator and victim are separated."
The amendment to the Criminal Procedure Act proposed by Rep. Chung in August includes the following as a "consideration point" when reviewing detention:
The bill includes provisions to include "risk of recidivism" and "possibility of harming the victim," which are currently only defined as grounds for detention.
