"There is little need for detention. There is insufficient evidence to support the detention, such as the risk of escape or destruction of evidence," Hwang said. After the state of emergency was declared on December 3 last year, he posted on social media in support of the law.
"A state of emergency has been declared. We must now uncover the pro-North Korean forces and the forces that have ruined the country," Hwang said. "The forces that have been committing election fraud must now be uncovered."
"We must eradicate it immediately. Take all emergency measures," he said. He also said, "Arrest National Assembly Speaker Woo Won-sik. Han Dong-hoon, who is directly obstructing the president's measures, is also arrested."
The special prosecutor's office said that Hwang recognized that the emergency martial law was not a legitimate exercise of authority and could be considered a "civil war."
Despite having been a member of the Public Security Prosecutor's Office, Mr. Hwang, who has served as Minister of Justice, leader of the ruling party, and Prime Minister, is actively involved in inciting civil unrest.
The special investigation team for civil unrest attempted to seize and search Hwang's residence twice, on the 27th and 31st of last month, but both attempts were unsuccessful as Hwang resisted by closing the door.
The Special Investigative Team for Civil Unrest also requested Hwang to appear for investigation three times through text messages and written documents, but Hwang refused all of the requests. The Special Investigative Team for Civil Unrest obtained an arrest warrant and arrested Hwang at his home on the 11th, and detained him.
The court also filed charges of obstruction of justice and obstruction of investigation under the Special Prosecutor's Act on Insurrection, citing that Hwang had resisted law enforcement and obstructed the investigation.
