Former President Yoon Seok-yeol's side requests court to change date for additional indictments against the special prosecutor for civil unrest (South Korea)
Former President Yoon Seok-gyeol's side is holding the first trial of the case indicted by the Special Prosecutor's team, Cho Eun-seok, who is investigating the civil unrest and foreign exchange scandals related to the emergency martial law imposed on December 3rd of last year.
According to the legal community on the 17th, former President Yoon's side submitted an application to the Seoul Central District Court's Criminal Division 35 on the 14th to change the trial preparation date.
The first preparatory hearing for the trial of former President Yoon on charges of special obstruction of public duties, abuse of power, obstruction of the exercise of rights, and the creation and use of false official documents is scheduled for the 19th.
Pretrial hearings are procedures that take place prior to a formal trial to confirm the defendant's position regarding the alleged crime and to develop a plan for investigating evidence. Unlike a formal trial, the defendant is not required to attend.
In the petition, former President Yoon's side argued that "we are unable to prepare for the defense because we have not been able to receive copies of the relevant investigation records from the special counsel and the selection of a defense attorney has not been completed."
The court has reportedly not yet decided whether to make the change. On the 19th of last month, the special counsel sent former President Yoon to trial while in custody.
On December 3rd of last year, former President Yoon only arranged the appearance of the Cabinet meeting before declaring martial law, and only convened a partial meeting, which he was unable to attend.
The nine commissioners are accused of violating the constitutional authority of the committee to deliberate and vote on martial law. After the emergency martial law was lifted, former Prime Minister Han Deok-soo and former Defense Minister Kim Yong-hyun were in charge.
He is also accused of creating a false declaration of martial law, which appeared to be signed by a minister, and destroying this document, which is a presidential record and a shared document.
In preparation for the investigation, he also ordered the deletion of confidential phone communication records of former National Defense Intelligence Commander Yeo In-hyeon and others, and in January of this year
He is also suspected of having the Presidential Security Service obstruct the execution of an arrest warrant by the High-Ranking Public Officials Crimes Investigation Agency.
The trial on charges of misconduct and abuse of power is currently underway at Criminal Affairs Division 25. Since his re-arrest on the 10th of last month, former President Yoon has not attended the trial for four consecutive times.
