Former President Yoon Seok-yeol's side: ”The special prosecutor is publicly humiliating us... We cannot cooperate with the investigation” (South Korea)
Former President Yoon Seok-gyol's team has claimed that Special Prosecutor Kim Gun-hee's repeated attempts to forcefully take people to Korea are "publicly humiliating" them.
On the 7th, former President Yoon's legal representatives issued a statement saying, "Even if an arrest warrant is issued for investigation, if former President Yoon exercises his right to refuse to testify, it should not be executed. It would be a public humiliation."
"There is no other explanation than that," he said. "The special prosecutor currently underway is conducting a unilateral investigation based on a conclusion that has already been decided, and is not considering any claims by former President Yoon.
In response, former President Yoon exercised his right to refuse to testify and made clear his intention not to cooperate with the investigation."
The defense team said, "If the suspect refuses to make a statement, the prosecution will decide whether to indict him or her based on the evidence and statements made so far.
"Former President Moon Jae-in also refused to summon the prosecution, and the prosecution indicted him without conducting an investigation," he said.
He continued, "If the special prosecutor is going to use physical force to coerce former President Yoon, the purpose is not to interrogate him, but to humiliate him.
"This is an admission that they are humiliating one person. The principles of the Constitution and the Code of Criminal Procedure, as well as standards regarding the human rights of suspects, must not be undermined just to humiliate one person," he emphasized.
Meanwhile, the Min Jung-ki special prosecutor team, which is investigating allegations against Kim Gun-hee, the wife of former President Yoon, announced on the same day,
They returned to Seoul Detention Center in Uiwang, Gyeonggi Province, to arrest former President Yoon, but failed.
This comes six days after the first failed arrest attempt in a single day.
Although the police used physical force on the day, they accepted the opinion of those on the scene that there was a risk of injury due to former President Yoon's stubborn refusal and suspended the execution of the arrest warrant.
The first attempted arrest failed because Yoon lay on the floor without a prison uniform and stubbornly resisted.
The special investigation team explained that the validity of the arrest warrant issued by the court to the special investigation team is up until this date. The special investigation team will either request a new arrest warrant or conduct a face-to-face investigation.
The government is expected to immediately begin considering whether to indict former President Yoon. Former President Yoon is the head of the special prosecutor team, Kim Kun-hee, in the case of the alleged interference in the election nomination by political broker Myung Tae-gyun.
Former President Yoon was arrested by the special prosecutor for insurrection on the 10th of last month and is currently being held at Seoul Detention Center.
