Special investigation team considers applying charges of complicity in rebellion to former Prime Minister Han Deok-soo (South Korea)
The investigation into former Prime Minister Han Deok-soo regarding allegations of civil unrest related to the state of emergency on December 3rd of last year has also gained momentum.

The special investigation team reportedly argued that the Minister of the Interior and Safety and the Minister of National Defense are the two pillars of martial law.
The special investigation team has concluded that the Minister of the Interior and Safety has command and control authority over the military, while the Minister of the Interior and Safety has command and control authority over the police and fire departments.
According to the Constitution and the Government Organization Act, the prime minister is responsible for overseeing the various administrative departments and directing and supervising the heads of administrative agencies under the orders of the president.
Any proposal to declare martial law by the Minister of National Defense or the Minister of the Interior and Safety must be submitted to the President via the Prime Minister. The Prime Minister also serves as the vice-chairman of the Cabinet Council.

That is the view of the special investigation team. In addition, former Prime Minister Han argued that former President Yoon Seok-yeol had drafted a post-martial law declaration to correct the legal flaws in the original declaration and then scrapped it.
He is also accused of committing perjury before the Constitutional Court and the National Assembly to the effect that he "failed to recognize the declaration of martial law."
The special investigation team summoned former Prime Minister Han on the 2nd of last month to investigate all the allegations. On the 24th of the same month, they also investigated former Prime Minister Han's home, the Prime Minister's official residence, and the home of Kang, the former Prime Minister's Attaché.
The prosecution plans to summon former Prime Minister Han once the analysis of the seized items is complete and confirm the overall charges against him. As former Prime Minister Han has completely denied the charges, an arrest warrant will be issued after questioning.
The possibility of claiming this has also been raised.
