Kim Moon-soo to President Lee Jae-myung: ”63.9% of the public agrees that the trial must continue” - South Korea
On the 8th, Yoon Sang Hyun, a People's Power lawmaker, claimed to President Lee Jae-myung that "63.9% of the public believes that the trial must continue."
On the same day, Rep. Yoon stated on Facebook, "We have the common sense that the people should be equal before the law, whether they are the president or anyone else."
Yoon said, "President Lee is scheduled to go on trial on June 18 for violating the Public Offices Election Act, and on the 24th for major corruption allegations involving the Daejang-dong Seongnam FC.
Both trials have been ongoing since before the election of the president. However, the Democratic Party is pushing ahead with a bill to halt the Lee Jae-myung trial, and is trying to halt even this. They are ignoring the people and going against the Constitution.
"This is an attempt to 'self-exonerate' himself, going against the spirit of the law," Rep. Yoon said, "Article 84 of the Constitution says that the president cannot be criminally prosecuted while in office, but Article 68, Clause 2 of the Constitution says that 'the president may not be prosecuted while in office.'
If an elected official loses his/her right to run for office due to a criminal conviction or other reason, a successor shall be elected within 60 days.
"The majority of legal professionals believe that this could result in the loss of the right to freedom of expression. Therefore, Article 84 of the Constitution must be interpreted together with Article 68, Clause 2, and President Lee should not avoid the trial," he added.
The Supreme Court also stated that "it is up to the relevant court to decide whether to continue the trial or not." The Seoul High Court and the Seoul Central District Court have also not issued a decision to suspend the trial.
In other words, the trial must continue," he wrote. In particular, "The will of the people is clearer. In the exit poll for the presidential election, 63.9% of voters answered that 'the trial must continue.'
"Even among the Democratic Party supporters, a whopping 42.7% were in favor of continuing the trial," he emphasized. "Nevertheless, the Democratic Party will force through the Lee Jae-myung trial suspension bill in the plenary session on the 12th," Rep. Yoon said.
"This is a direct challenge to the people and an unconstitutional idea that gives special privileges to the president. Aren't you afraid of the people?"
He added, "The president is no exception. Standing on trial and humbly accepting the judgment of the law is the true sign of responsible politics."
did.
